Ombudsman indicts ex-president Noynoy Aquino, Budget Sec. Abad over multi-billion DAP scam

The office of the Ombudsman found probable cause to indict former President Benigno Aquino and his cabinet former Budget Secretary Butch Abad for alleged usurpation of powers in connection with the controversial P72-billion Disbursement Acceleration Program (DAP).

In a statement on Wednesday, the Ombudsman said Aquino and Abad will be charged for violation of Article 239 of the Revised Penal Code due to the alleged unlawful issuance of the National Budget Circular no.541 for the implementation of DAP.


“A re-evaluation of the case establishes that the individual actions of respondent Aquino and respondent-movant Abad showed a joint purpose and design to encroach on the powers of Congress by expanding the meaning of savings to fund programs, activities and projects under the DAP,” the Ombudsman resolution said

“The evidence on record shows that an exchange of memoranda between (Aquino) and (Abad) precipitated its issuance,” the resolution added.

The issuance authorized the release of P72 billion in funds through the withdrawal of unobligated allotments from various government agencies in 2012.


Ombudsman has ordered the indectment after acting on the filed motions for reconsideration by the complainants-movant Representative Carlos Isagani Zarate, Renato Reyes, Benjamin Valbuena, Dante LA Jimenez, Mae Paner, Antonio Flores, Gloria Arellano and Bonifacio Carmona, Jr.

The complainants urged the Ombudsman to reverse its March 7 decision dropping the case to administrative charges against Aquino and hold him criminally liable for approving Disbursement Acceleration Program which was proposed by Abad.

The DAP is suppose to boost economic growth through fast tracking the release of funds for priority projects of the government.

Last year, the Ombudsman has also indicted Aquino for usurpation of authority and violation of the anti-graft and corrupt practices act over the botched anti-terror raid in Mamasapano, Maguindanao province in 2015, where 44 police commandos were killed.

  1. PROSECUTE THEM FAST AND PASS IT ON TO THE SANDIGAN COURT FOR FAST TRIAL. IF THEY ARE FOUND GUILTY, JAIL THEM WITH DESPATCH.
